ADA Compliance
The Americans with Disabilities Act (ADA) is a United States law that disallows discrimination against people with disabilities. Websites are subject to the ADA. Having an ADA-compliant website protects your business from lawsuits and cultivates an inclusive environment for your potential consumers.
WHAT IS ADA COMPLIANCE?
The Americans with Disabilities Act (ADA) is a civil rights act that was passed in 1990 protecting the rights of people with disabilities by guaranteeing they are entitled to the same rights as those without disabilities.
The Department of Justice (DOJ) published the Americans with Disabilities Act (ADA) Standards for Accessible Design in September 2010. These standards state that all electronic and information technology must be accessible to people with disabilities.
The ADA is different from Section 508. Click here to learn about Section 508
WHO IS REQUIRED TO COMPLY?
If your business falls in any of the below categories then the ADA is applicable-
- A business with at least 15 full-time employees
- To employment agencies and labor unions regardless of the number of employees
- Public bodies like state and local governments
HOW TO COMPLY WITH ADA ONLINE WEB COMPLIANCE?
The DOJ is working on establishing rules that specifically govern web accessibility covered under the ADA.
Many organizations follow the Web Content Accessibility Guidelines (WCAG) as a guide to becoming accessible until the DOJ defines the regulations.
WCAG
WCAG is the W3C guidelines for websites to achieve web accessibility.
WCAG version 2.0 level A and AA are the most widely used conformance levels globally for WCAG compliant websites.
As the ADA doesn’t have a regulatory standard for accessibility yet and if you want to minimize your legal exposure, we’d recommend conforming to WCAG 2.1 AA guidelines.
